The burden of proof is on the immigrant – within reason – and the circumstances. In today’s context, this may include: conducting an interview with border officials, presenting a valid passport, applying for a VISA, obtaining a valid criminal record, etc.

However, once that burden is met, the government may not limit entry due to economic quotas, and other collectivist forms of immigration restriction.
